Hi Heisen. I'm an attorney practicing in California. Non-compete clauses are no longer enforceable anywhere in the USA, and NDAs must be very reasonable to be legally binding. Signing an agreement doesn't automatically make it legal. NDAs require many specific conditions to be met, and their enforceability varies by state. If the other party breaches a contract, NDAs and other agreements can become null and void. If someone backs out of a contract with you, that contract is null and void, and you have grounds to sue them.

If you're interested, I can refer you to an attorney who can assist you pro bono. It's also a good idea to reach out to other disgruntled employees for statements. If the contracts weren't fulfilled, you have every right to sue, and you won't need to pay any upfront costs.

The same applies to the NDA: while you most likely will be able to obtain a financial settlement, you will still need to comply with the legal provisions of the contract. It's likely that some clauses in the contract may not be enforceable in court, but any reasonable terms will have to be followed by both parties.

A suit would no doubt include injunctive relief up to and including rescission. Non-payment as @Heisen claims almost certainly amounts to breach.

I'd be willing to bet that this is the sticking point for most craft growers and breeders is the hesitancy to get legalese involved. Word of mouth deals and/or short-word written contracts with loopholes galore. I don't know anything about this situation in particular but I don't know a lot of professional stoners with lawyers on retainer.

This is a good opportunity for you to cut that shit loose. It bothered me that you weren't being paid when It's your work I've been paying for. Long live seedlys!we got your back
