Is THCa Federally Legal?

I recently came across an article about THCA carts and their legal status, and I wanted to get your thoughts on it. According to this post, THCA carts are considered federally illegal, but I've noticed them being sold at some stores near me, which left me quite puzzled.

I was wondering if any of you could shed some light on this topic. Is this information accurate? How are these stores able to sell THCA carts if they're federally illegal? Are there any loopholes or state-specific regulations that allow them to do so?

I'd appreciate any input you might have on this subject, as I'm trying to stay informed and make responsible choices when it comes to cannabis consumption.

They are able to sell hemp derived THCa because of a loophole. As long as the percentage of THCa is below 0.3% of the total weight of the product, AND it comes from legal hemp, then it is considered legal. So, for example, a gummy that weighs 1 gram would be legal if it had under 0.3g of hemp derived THCa in it. I wouldn’t be surprised to see this loophole closed in the future, though, since THCa turns into D9 THC when it is decarboxylated.

I think you may be reading the package wrong. There's a thread on here where a member posts pics of the Delta8 stuff he gets. On the front in bold print it states "less than 0.3 THCa". You have to look real hard to find the part where it's chemically distilled hemp leftovers, but they put the THC thingy right out front.

From what I’ve seen, the legal gray area comes down to how THCa converts to Delta-9 when heated. Even if it starts as THCa and meets the Farm Bill’s definition of hemp, once it’s decarbed, it could go over the legal Delta-9 limit. That’s why people compare it to delta 9 gummies—because in the end, it’s all about how much active Delta-9 ends up in your system.

There is a perceived loophole but it was closed in 2021. Enforcement has been lax but that's very different than it being legal.
